Intellectual Property Claim
If you believe that African Pride has infringed your intellectual property rights, you can file a complaint using our email address support@afroprintwear.com. Below is the procedure for reporting intellectual property infringement.
A. How to Report Intellectual Property Infringement
Our policy includes:
- Blocking or removing any content (text, graphics, photos) that we believe in good faith infringes on third-party intellectual property rights upon receiving a valid notice.
- Terminating services to repeat infringers.
If you believe content on our website violates your intellectual property rights, please send a notice with the following information to our Designated Agent, or submit it via our email support@afroprintwear.com:
- Identification of the copyrighted work or intellectual property being infringed, including registration numbers if applicable.
- Identification and description of the infringing content, including its location on our website.
- Your contact information (full name, address, phone number, email).
- A statement that you have a good faith belief the disputed use is unauthorized.
- A statement, under penalty of perjury, that the information in your notice is accurate and you are the rights holder or authorized to act on their behalf.
- An electronic or physical signature of the rights holder or authorized agent.
B. Actions Taken Upon Receiving a Valid Notice
Upon receiving a valid notice, we may:
- Remove or disable access to the infringing material.
- Notify the content provider of the removal or disablement.
- Terminate the content provider’s access to our services if they are a repeat offender.
C. Counter-Notice Procedure
If we believe that the removed content is not infringing or that we have the right to use it, we may submit a counter-notice to the Designated Agent with the following information:
- Identification of the content that was removed and its location before removal.
- A statement under penalty of perjury that the content was removed due to a mistake or misidentification.
- Our contact information (full name, address, phone number, email).
- A statement consenting to the jurisdiction of the Federal Court for our district.
- An electronic or physical signature.
If a counter-notice is received, we may notify the original complainant and replace the removed content or restore access within 10-14 business days, unless the rights owner seeks a court order to prevent this.
Please note: Under Section 512(f) of the DMCA, any person who knowingly submits a false claim may be liable for damages, including attorney's fees.
